Senior IPS officer, Amitabh Thakur, has sought permission from the State government to file Public Interest litigation (PIl) against them regarding rapid and frequent transfers of senior administrative officers and incharges of police stations. In his representation to Principal Secretary Home, dispatched on Wednesday, Amitabh Thakur, presently posted as IG (Civil Defense) said that the State government itself passed two Government orders on 26 December 2010 fixing 2 years as minimum tenure of all police officers from Station Officer to DGP. Again after the Supreme Court order in TSR Subramaniam case, the Government of India amended the IAS, IPS Cadre Rules to make 2 years as the mandatory minimum tenure.
He said that despite these legal provisions, these responsible officers are being transferred every day, leading to definite effect on governance. Thakur sought permission for filing PIl in compliance of an earlier High Court order which directed him to take first taken government’s permission than proceed with filing of PIl in the matter.
Meanwhile a PIl has been also filed in the lucknow bench of Allahabad High Cour by Charitable Trust Center for Civil liberties as regards complete apathy towards the recommendations sent by lokayukta to the State government against ex Ministers Nasimuddin, Ramveer Upadhyaya, Ratan lal Ahirwar, Swami Prasad Maurya etc and public servants like IAS Mahesh Gupta.
Petitioner’s advocate Dr Nutan Thakur told that since 2011, lokayukta has sent Special reports to the Governor under section 12(5) of the lokayukta Act in 43 cases, where, as per section 12(7) of the Act, the action-taken report should have got placed before the State Assembly, which has been done in only 1 case. After the Governor directing the Chief Minister on 12 September 2014 and 27 April 2015, in 19 cases action has been taken but the report not placed before the Assembly. In 23 cases no action has been taken so far. As per Dr Thakur, the PIl seeks presenting the action-taken report in these 19 cases before the State Assembly definitely in the forthcoming session and also prays for directing the State government to necessarily take appropriate action in rest 23 cases within 01 month so as to place the action-taken report before the Assembly at the earliest.
